Department of Labor Special Investigations
DOL finally issued the findings from special investigations they conducted about two and a half years ago to see how well community rehabilitation programs were complying with wage-hour laws. DOL looked at 70 out of over 3000 CRP's in conducting the survey/investigations.
The findings summarized by DOL indicated that there may be significant shortcomings in properly paying workers with disabilities or consumers. DOL stated in the Fact Sheet 39G, that only 36% of CRP's were in compliance with the monetary provisions of the Fair Labor Standards Act and the Service Contracts Act. 74% properly paid staff but only 37% properly compensated consumers. When looking at individual consumers, DOL said that just over 77% of consumers looked at were paid in compliance with FLSA and SCA special wage provisions. DOL did not provide any detail about the violations found or the level of back wages due to consumers. They did mention that most involved piece rate issues including incorrect prevailing rates being used to determine piece rates.
A copy of the text of the Fact Sheet can be downloaded. Each CRP with a special certificate is being mailed a letter and a copy of the Fact Sheet 39G.
DOL is expected to use the results of the survey/investigations to conduct investigations of CRP's holding the special Section 14(c ) certificates.
